The ARQRV is able to assist its members if they have a dispute with the retirement village operator. In retirement villages the Act states the grounds for a dispute must be either the Retirement Villages Act 1999 or the resident’s own contract.
For residents living in freehold retirement villages there is an additional Act (The Body Corporate and Community Management Act 1997). This Act also has a section dealing with the resolution of disputes involving the operator and/or the Body Corporate Committee.
The Department of Justice and Attorney-General manages the disputes for both Acts, but DOES NOT PROVIDE LEGAL ADVICE TO EITHER PARTY.
